This Privacy Policy describes how Indihomes collects, uses, stores, shares, and protects your personal information when you use our services.

1. General

Internovo Ventures Private Limited, a company incorporated under the laws of India ("Internovo", "the Company", "we", "us" or "our"), owns and operates Indihomes, a real estate platform that helps users search, list, buy, sell, rent and lease residential and commercial properties, and connect with real estate agents, brokers, developers, and other service providers ("Indihomes Services"). Indihomes Services are made available through our website, mobile application, and any other associated online or offline channels (together, "Indihomes Sites").

We are committed to protecting your privacy and earning your trust. This Privacy Policy ("Policy") describes how we collect, use, store, share, and protect personal information when you access or use Indihomes Services. We may, in our sole discretion, revise this Policy from time to time by posting an updated version on our website. If we make any material change, we will notify you by email (as listed in your account profile) or through a notice on the Indihomes Sites prior to the change taking effect.

This Privacy Policy is published in compliance with, inter alia:

  • Section 43A of the Information Technology Act, 2000 ("IT Act");
  • Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"); and
  • Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

2. Definitions

For the purpose of this Policy, wherever the context so requires:

  • The terms 'You' and 'User' mean any person or entity accessing or using Indihomes Services, who is competent to enter into a binding contract under the Indian Contract Act, 1872;
  • The terms 'We', 'Us' and 'Our' mean Indihomes and/or Internovo Ventures Private Limited, as the context so requires;
  • The terms 'Party' and 'Parties' refer to the User and the Company, individually and collectively, as the context so requires.

3. What Information Does Indihomes Collect?

If you use or access Indihomes Services, create an Indihomes account, list or enquire about a property, or visit the Indihomes Sites, we may collect and store the following categories of information for the purpose of providing you the Indihomes Services:

  • Contact information, such as your name, address, phone number, email address, date of birth, and other similar details.
  • Property preference information, such as the type of property you are looking for, budget, preferred locations, purpose (buying, selling, renting, or leasing), and property listings you have saved, favourited, or enquired about.
  • Financial information, such as income details or bank account information, if you choose to share this with us to avail home loan assistance, EMI calculators, or similar services facilitated through Indihomes.
  • Detailed personal information, such as your Permanent Account Number (PAN) or Aadhaar number, which may be collected for identity verification in connection with a property transaction, site visit registration, or compliance with applicable real estate and anti-money laundering regulations. Indihomes does not store your biometric credentials and adheres to the norms specified by UIDAI where Aadhaar-based verification is used.
  • Information from your smartphone as permitted by the relevant app store policies. You authorise Indihomes to access this information, and you agree that we may collect and use it in accordance with this Policy.
  • Other personal information provided by third parties, such as credit bureaus, identity verification services, and property listing partners (agents, brokers, and developers).
  • Your photograph, if you choose to add one to your profile. Other users of Indihomes Services may be able to view your photo. You may remove or change it at any time in your account settings.
  • Information that you provide when interacting with our customer support team or other team members via phone, email, online form, chatbot, or other correspondence.
  • Personal information stored with third parties that you choose to share with Indihomes, such as social media account information and contacts. By linking a third-party account or using a third-party sign-in service, you authorise Indihomes to access this information and agree that we may collect and use it in accordance with this Policy.
  • Personal testimonials, reviews, or endorsements that you voluntarily provide and which we may display with your name on the Indihomes Sites with your consent. To update or delete your testimonial, contact us at compliance@internovo.in.

We also collect the following information ("Web Browser Information") from your device when you use Indihomes Services: your IP address, the type of device you use, your device identifier, operating system version, browser type, the URL you came from, and the next URL you visit.

As a security measure and to facilitate services such as showing nearby property listings, scheduling site visits, and verifying check-ins at a property location, Indihomes may access your device's location, based on the consent you provide while using the Indihomes Sites. If you have enabled location collection in the Indihomes mobile application, you can turn it off at any time within the application's settings on Android, or in your phone settings on iOS.

4. How Does Indihomes Use the Personal Information It Collects?

We use your personal information to:

  • Provide Indihomes Services to you, including listing, searching, and enquiring about properties.
  • Connect you with real estate agents, brokers, developers, landlords, or other users relevant to your enquiry or listing.
  • Notify you about your account activity, saved searches, and property enquiries.
  • Process transactions and collect applicable fees, such as brokerage or listing charges.
  • Provide customer support and resolve disputes.
  • Verify your identity and account information.
  • Identify, prevent, and report potentially prohibited, fraudulent, or illegal activities, including fake listings.
  • Customise and improve your Indihomes experience and the Indihomes Services, including personalised property recommendations.
  • Contact you at your phone number by voice, SMS, or WhatsApp to validate your number or your Indihomes account, or to coordinate site visits.
  • Notify you about important changes to Indihomes Services and/or our terms and conditions.
  • Provide you with news, offers, and information about Indihomes Services based on your communication preferences.
  • Assess your eligibility for home loan assistance or related financial products, where you have opted for such services.
  • Any other purpose that we disclose to you in the course of providing Indihomes Services.

5. How Does Indihomes Share My Personal Information?

We may share your personal information as follows:

  • When you enquire about, list, or transact on a property, with the relevant seller, buyer, landlord, tenant, agent, broker, or developer involved.
  • With third parties to provide, maintain, and improve Indihomes Services (and not for those third parties' own purposes), including fraud prevention, identity verification, analytics, customer relationship management, marketing services, payment processing, and financial institutions or partners involved in home loan facilitation.
  • With third parties upon your request.
  • If we believe disclosure is reasonably necessary to comply with applicable law, legal process, or a government request; to investigate or bring legal action against someone violating our rights, our terms and conditions, or the rights of others; or to protect the safety and security of Indihomes, our users, or the public.
  • With a third party if we are involved in a merger, acquisition, or sale of all or a portion of our stock or assets. If this occurs, you will be notified of any change to this Policy, as well as any choices you may have regarding your personal information.
  • As aggregated, non-personally identifiable information, which we may share with third parties.

Other than as stated in this Policy, Indihomes does not disclose or sell any of your personal information to third parties without your consent. Please note that third parties, such as agents, developers, and third-party websites you visit through Indihomes, have their own privacy policies, and Indihomes is not responsible for the policies and practices of such third parties.

6. How Does Indihomes Use Cookies and Web Beacons?

Cookies and web beacons are technologies that Indihomes and our third-party service providers use to collect Web Browser Information in order to understand how the Indihomes Sites and Services are used. Cookies are small data files stored on your device's hard drive, and web beacons are tiny graphics embedded on web pages. These technologies allow us to: provide you with a personalised experience by recognising you when you return to the Indihomes Sites; better understand our users by tracking how they use Indihomes Services; improve the design and content of the Indihomes Sites; and identify and prevent fraudulent activity, such as fake listings. We may link Web Browser Information to any personal information you submit on the Indihomes Sites. Our third-party service providers may use cookies and web beacons to provide analytics services to Indihomes or to serve you advertisements in connection with Indihomes Services.

7. Regulatory Disclosures

If Indihomes is required to disclose any personal information by law, rule, regulation, law enforcement, a governmental official, legal or regulatory authority, statutory body, court order, or other legal process, or for any tax authority, your personal information may be disclosed pursuant to such order or process, which may occur without notice to you. Indihomes may further disclose your personal information to third parties to whom it transfers its rights and duties under any agreement entered into with such third parties, and may also disclose your personal information to any of its affiliates or related entities.

The Indihomes Sites include social media features that allow you to "Like" or share content on third-party sites. These features may be hosted by the third-party site or by the Indihomes Sites, and may collect your IP address, the Indihomes page you are visiting, and may set a cookie to enable the feature to function. You can change your browser settings to refuse cookies, but this may interfere with your use of the Indihomes Sites.

This Policy does not apply to third-party cookies, web beacons, social media features and widgets, or other tracking technologies used by third parties, such as listing partners or advertisers. Indihomes is not responsible for the privacy policies and practices of such third parties.

8. How Do I Opt Out of Receiving Promotional Communications from Indihomes?

If you prefer not to receive promotional emails, SMS, or WhatsApp messages from Indihomes, click on the unsubscribe link at the bottom of any promotional email, or reply 'STOP' to opt out of SMS/WhatsApp communications, to remove yourself from future promotional campaigns. 9. What Security Precautions Does Indihomes Take to Protect Me?

We have security measures in place to protect your personal information, including industry-standard data encryption technology and internal policies and restrictions regarding the storage of and access to your personal information. If you request that we destroy your data, we do so in line with applicable industry compliance and best-practice standards. Please note that no data transmission over the internet or method of electronic storage can be guaranteed to be 100% secure. Indihomes ensures that data is collected and stored in a secured environment. To request data deletion, please contact our customer care centre or email compliance@internovo.in.

10. How Does Indihomes Act in Case of a Security Breach?

In the event of a data breach, Indihomes investigates the extent of the breach, takes necessary action to minimise its impact, and informs relevant stakeholders within the timeframe notified by the applicable regulatory bodies. 11. How Do I Update My Information?

If your personal information changes, you can update or correct it in your account settings by logging into your Indihomes account. We will retain your information for as long as your account is active or as needed to provide you Indihomes Services. If you wish to close your account or request that we no longer use your information to provide you Indihomes Services, contact us at compliance@internovo.in. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our terms and conditions.

12. What Data Privacy Rights Does Indihomes Provide?

Indihomes provides you the right to deny your consent for the use of specific personal data by Indihomes, restrict disclosure of your personal data to third parties, limit data retention, and revoke consent already granted for the collection of your personal data. These rights are subject to your use of Indihomes Services and any applicable regulatory or legal requirement, and in some circumstances Indihomes may not be able to honour a request to exercise these rights. Where Indihomes agrees to honour such a request, this may result in the non-availability of some or all Indihomes Services to you. 13. Public Forums and User-Generated Content

The Indihomes Sites may offer publicly accessible reviews, ratings, blogs, or community forums, which may require the creation of an account or a third-party login. Any information you provide in these areas may be visible to the public, so we recommend that you avoid disclosing personal information there. To request removal of your personal information from these areas, contact us at compliance@internovo.in. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
